Mexico’s Supreme Court of Justice declared Thursday, September 9 that Article 4 of the Constitution of Sinaloa, which protects the right to life from conception, should be annulled.
It argues that the Supreme Court does not define when human life begins and therefore neither can local congresses in their constitutions.
Excuse me? So, if Supreme Court justices can’t read scientific evidence, does that mean no one else can either?
Is there any scientific debate about the beginning of human life? None! On the contrary, there is a clear consensus that human life begins at the moment of conception. And it has even been affirmed that at that moment of conception, a unique and unrepeatable human life begins, different from all the others, with a unique fingerprint, whose heart will begin to beat in a very short time.
All first-year medical graduates can attest to this scientific evidence endorsed by 100% of the world’s medical schools. But Mexico’s Supreme Court can’t read?
There is something worse than professional incapacity, and that is judicial activism. The Court’s failure (how well said) violates the first and foremost of the human rights: the right to life. How can it be that the judicial body in charge of the defense of human rights is violating the first of these rights? That’s how serious it is.
But there’s more. The Supreme Court–or the #SupremeInjustice as it has been renamed in social media–has violated the federal pact and the sovereignty of the states. It turns out that 23 states in Mexico’s local constitutions protect the right to life from conception. But the #SupremeInjustice says that this is a dead letter, ignoring the sovereignty expressed in the congresses. Respect the institutions!
Progressives all over the world have applauded the decision–even in advance–and welcomed it with enthusiasm worthy of a better cause. But we don’t give up. There is still a battle to be fought; waged with a rebellion of the states that raise the question of unconstitutionality because of the violation of the federal pact and the sovereignty of the states.
