Italy’s center-right parties say “No” to EU certificate of filiation

According to a circular issued by the Ministry of the Interior through the prefect, the Municipality of Milan stopped the registration of children born to same-sex couples in Italy.

In Italy, the rights of children of same-sex couples ended up at the center of political discussion. The City of Milan discontinued the registration of children born to same-sex couples, thus igniting controversy, and the center-right is blocking the European certificate of filiation. This certificate aims to enable that parenting established in one member state is recognized in all other member states, without a special procedure.

“In fact, the Senate European Policy Committee approved with 11 out of 18 votes in favor a majority resolution (submitted by the rapporteur, former Foreign Minister Giulio Santagata) opposing the proposed regulation.

All of the opposition was united in their “No” vote, but this was not enough to pass the proposal. The text of the resolution–presented by Senator Terzi–argues that the obligation to recognize the EU filiation certificate does not comply with the principles of subsidiarity and proportionality, so if it were adopted it would be an encroachment of European law on national law.

Particularly when it comes to surrogacy, a form of assisted procreation used by gay and heterosexual couples that is currently banned in Italy and feared to be circumvented with the proposed regulation’s okay,” LadyBlitz magazine reports.
