The Spanish Foundation of Christian Lawyers has filed a complaint with the European Commission against the Kingdom of Spain for violating Article 54 of the Charter of Fundamental Rights of the European Union, which expressly prohibits the abuse of rights.

The jurists’ organization considers that Spain is abusing the abortion law in cases of repeat abortions.

Since 1988 (the first year for which data are recorded), abortions performed on women who had already undergone this procedure on at least one other occasion have accounted for more than 30%. In 2021 (the last year with recorded figures), more than 30,000 repeat abortions were performed, of which 4,000 involved women who had undergone the procedure three or more times already.

The president of Christian Lawyers, Polonia Castellanos, said that “in many cases, these repeat abortions cover up cases of abuse and prostitution, and abortion centers look the other way out of economic interest”.

Castellanos noted that Spain is complicit in this situation and asked that “an end should be put to this practice and greater transparency demanded of abortion centers, which are still private companies financed with everyone’s money”.

In its brief to the EC, the Foundation of Christian Lawyers argued that “using a right does not grant the power to abuse it. The law does not protect the abuse of the right, which may manifest itself in an act or in an omission; the abuse appears whenever the normal limits of the exercise of a right are exceeded”.

And it assured that “in such cases, the law provides that the injured party shall be granted the corresponding right to be compensated and judicial or administrative measures shall be adopted to prevent the persistence of the abusive or antisocial act”.
