Spanish police are investigating a series of suspicious births at the University Hospital of Burgos involving around 30 Brazilian women who traveled from Belgium to Spain shortly before giving birth, raising concerns about a possible international surrogacy network.
Between early May and late June 2026, the women reportedly arrived in Burgos while heavily pregnant or close to delivery. Hospital staff became suspicious after noticing that nearly all of them provided the same two residential addresses and were often accompanied by the same man. The hospital alerted local police, who are now investigating whether criminal offenses were involved.
The case centers on a legal difference between Spain and Belgium.
Spain generally follows citizenship by descent, but makes an exception for children born on Spanish territory to Brazilian parents in order to prevent them from becoming stateless under Brazilian nationality rules. This means a child born in Spain to Brazilian parents may receive Spanish citizenship.
Belgium, by contrast, applies a stricter citizenship-by-descent system. A child born in Spain with Spanish nationality can then move to Belgium as an EU citizen, while the parents may potentially obtain residency rights through family reunification.
Belgian authorities are already aware that this legal route can be used for immigration purposes. However, the circumstances surrounding the Burgos births have raised a more serious possibility: that the women may be part of an organized surrogacy operation serving clients in Belgium.
Belgium permits so-called altruistic surrogacy, under which surrogate mothers are not supposed to be paid. But critics have long warned that domestic restrictions do not prevent intended parents from turning to international networks operating across borders.
The Burgos investigation now raises fresh questions about whether citizenship rules intended to prevent statelessness are being exploited to facilitate cross-border surrogacy arrangements and secure European residency rights.
