Poland’s center-left government under Prime Minister Donald Tusk is dodging the nation’s Constitution to bow to a European Court of Justice (ECJ) ruling demanding recognition of same-sex “marriages” from other EU states. On January 16, 2026, the Ministry of Digital Affairs announced gender-neutral tweaks to civil documents, swapping “woman” and “man” for “first spouse” and “second spouse” to register foreign unions without legislative changes.

This stems from a November 2025 ECJ verdict closing a case involving two Polish men who wed in Berlin in 2018. Denied registration back home due to Poland’s ban on same-sex marriage, they forced the issue, compelling Warsaw to comply despite no domestic law shift. Deputy Prime Minister Krzysztof Gawkowski framed it as a “legal obligation” for “efficient and equal” operations, sidestepping ideology—but it’s a clear capitulation to Brussels’ overreach.

The move reeks of EU imperialism, trampling national sovereignty on family matters. Poland’s Constitution explicitly defines marriage as between a man and a woman, a bulwark against radical redefinitions. The Polish Catholic Church, alongside right-wing stalwarts like PiS and Confederation, fiercely opposes this as a stealth path to full same-sex marriage. President Karol Nawrocki, a conservative guardian, has vetoed similar EU dictates, viewing them as assaults on traditional values.

Poland’s Constitutional Court has repeatedly affirmed the Constitution’s supremacy over EU edicts, echoing Germany’s stance. Yet Tusk’s regime prioritizes Brussels’ whims over Polish heritage, eroding self-determination amid broader cultural battles.This precedent endangers Europe’s diverse traditions, demanding resistance to preserve national identities against supranational meddling.
