The U.S. Department of Education has rescinded portions of six Biden- and Obama-era Title IX resolution agreements, marking another major reversal of the federal government’s prior effort to impose transgender ideology on schools through civil-rights enforcement. The Department announced on April 6 that its Office for Civil Rights would no longer monitor or enforce parts of agreements involving five school districts and one college, saying those deals were built on an unlawful interpretation of Title IX that treated “gender identity,” rather than sex, as the governing category.
The affected institutions are Cape Henlopen School District, Delaware Valley School District, Fife School District, La Mesa-Spring Valley School District, Sacramento City Unified, and Taft College. According to the Department, previous Democratic administrations used resolution agreements to pressure schools over matters such as preferred pronouns, gender-related questioning, and policies involving intimate spaces and student treatment. Assistant Secretary for Civil Rights Kimberly Richey said the administration was removing “unnecessary and unlawful burdens” and restoring a common-sense reading of federal law.
The move follows the return to the Trump administration’s 2020 Title IX rule after a federal district court in January 2025 vacated the Biden administration’s 2024 Title IX final rule. The Department now says its enforcement position is again based on sex discrimination as defined in the statute, not on broader theories of gender identity advanced under previous administrations.
Predictably, critics on the left are denouncing the decision as a rollback of protections. But the administration argues the deeper issue is whether federal bureaucrats can invent obligations that Congress never enacted. That question has now become central to the broader national fight over schools, parental rights, girls’ sports, and the meaning of Title IX itself.
This is about more than administrative cleanup. It is a direct challenge to the idea that federal agencies may redefine sex by fiat and then force schools to comply. For many parents, that correction is long overdue.
