Marcus Silva is the first father to file a wrongful death lawsuit over the unlawful abortion of his unborn child. He is suing three women who helped his then-wife obtain illegal abortion pills and hide the murder of their unborn child from him, LifeSiteNews reports.
The lawsuit was filed on 9 March 2023 by attorneys for the Thomas More Society in the District Court of Galveston County, Texas, and will sue the manufacturer of the mifepristone used in the abortion once it is identified. Texas has imposed civil liability on anyone who assists in an illegal abortion, and abortion has been illegal in Texas since 24 June 2022, after the US Supreme Court issued its ruling in Dobbs v. Jackson Women’s Health Organization. The women who assisted in the illegal abortion also face murder charges.
The lawsuit acknowledges that Silva’s wife sought help from Jackie Noyola and Amy Symmank Carpenter in obtaining illegal abortion pills after discovering she was pregnant. In a series of text messages, the trio conspired to kill the unborn child with abortion-inducing drugs. Noyola and Carpenter offered their homes for the abortion, and Noyola conspired with Aracely Garcia to obtain the abortion pills in Houston and deliver them to Silva’s wife so she could abort her baby.
Briscoe Cain, an attorney for Marcus Silva, warned that Texas law allows wrongful death lawsuits against anyone who distributes or manufactures abortion pills used by Texas residents, and that Silva’s legal team will sue anyone proven to have been involved in the manufacture or distribution of the abortion pills used by Silva’s wife. Silva makes no claims against his former wife, who is immune from civil and criminal liability under Texas law.
