The Spanish Foundation of Christian Lawyers has filed a complaint before the European Commission against Spain for violating the Charter of Fundamental Rights with the Amnesty Law. It stated that this law puts an end to the principle of equality among all Spaniards and to the independence of the Judiciary.
The lawyers’ organization recalled that “under Article 258 of the Treaty on the Functioning of the European Union, if the Commission considers that a Member State of the Union is not fulfilling one of its obligations under the Treaties, it shall deliver an opinion on the matter”.
Christian Lawyers underlined that “with the Amnesty Law, Spain would be in breach of Article 2 of the EU Treaty, which establishes that the Union is founded, among others, on the value of the rule of law and justice, and of Article 20 of the Charter of Fundamental Rights, which establishes equality before the law for all citizens”.
Christian Lawyers encourages all citizens to file complaints in their personal capacity and has launched a guide on how to file a complaint.
The president of Christian Lawyers, Polonia Castellanos, stressed that “we hope that in this case the European Commission will act as it did with other countries such as Romania, which spoke out when the country’s government tried to control judges and overturn court rulings”.
Let us hope that the EU government, with hundreds of complaints, will prevent the rule of law from being overturned in Spain”.
