On Tuesday, June 21, 2022, the Biden administration announced proposed changes to the administrative regulations regarding Title IX of the Educational Amendments of 1972 that ban discrimination based on sex in education programs funded by the federal government. Among other things, the proposed changes would expand the definition of “sex” to include “sexual orientation” and “gender identity,” two things that the drafters of Title XI never had in mind. As a result of this change, federal funds would be denied to any educational institution that discriminates based on sexual orientation and gender identity. As the notice of the proposed changes states:
“[T]he proposed regulations would:
• Articulate the Department’s understanding that sex discrimination includes discrimination on the basis of sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity…[and]
• Clarify that, unless otherwise provided by Title IX or the regulations, a recipient must not carry out any otherwise permissible different treatment or separation on the basis of sex in a way that would cause more than de minimis harm, including by adopting a policy or engaging in a practice that prevents a person from participating in an education program or activity consistent with their gender identity….”
As the press release regarding the changes declares:
“The regulations will require that all students receive appropriate supports in accessing all aspects of education.” (Italics added.)
Thus, the proposed changes would force educational institutions, from elementary schools to colleges, that want to continue receiving federal funds to open to biological males who think they are females all spaces and teams, such as restrooms, locker rooms, showers, dormitories, and sports teams, that were formerly reserved solely for biological females. Among other things, this means that the many states that have passed laws to protect such spaces and teams for biological females would now have to rescind such laws if they want to continue receiving the billions of dollars the federal government gives out each year in education funds.
As reported by the Daily Caller, Erica Sanzi, outreach director for Parents Defending Education, stated:
“Title IX has always guaranteed single sex space restrooms, locker rooms, and interscholastic athletics. A shift from biological sex to gender identity means that girls and women will be forced to accept the presence of biological males in what have always been single-sex spaces… Dignity and respect matter for everyone but so do fairness and safety and these proposed changes represent a total rejection of fairness and safety in the name of ideology.”
So there you have it. One again, Joe Biden, the “first LGBT president,” is putting the interests of males who think they are females ahead of the legitimate interests of our girls and women. To Joe Biden and his supporters, there is nothing special about being a female; indeed, for them, anyone can become a female just be saying so. Let’s hope that those of us who support girls and women will rise up to block Biden’s proposed changes to the regulations regarding Title IX from going into effect. And let’s hope that Biden’s continued pandering to the radical LGBT mob will continue to erode his support among Hispanics and Blacks that support traditional values.
