{"id":67539,"date":"2021-04-23T10:03:10","date_gmt":"2021-04-23T14:03:10","guid":{"rendered":"https:\/\/ifamnews.com\/?p=67539"},"modified":"2021-04-23T10:03:11","modified_gmt":"2021-04-23T14:03:11","slug":"biden-administration-seeks-to-continue-obama-era-legacy-of-bullying-nuns","status":"publish","type":"post","link":"https:\/\/ifamnews.com\/en\/biden-administration-seeks-to-continue-obama-era-legacy-of-bullying-nuns","title":{"rendered":"Biden administration seeks to continue Obama-era legacy of bullying nuns"},"content":{"rendered":"\n<p>On April 20th, Luke Goodrich\u2014vice president and senior counsel at <a href=\"https:\/\/www.becketlaw.org\/staff\/luke-goodrich-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">Becket<\/a>\u2014announced on Twitter that the Biden administration had filed an appeal in Federal court that seeks to force religious benefits associations, and religious doctors and hospitals, to pay for (by insurance) and to perform &#8220;gender transition&#8221; procedures.<\/p>\n\n\n\n<figure class=\"wp-block-embed aligncenter is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/BREAKING?src=hash&amp;ref_src=twsrc%5Etfw\">#BREAKING<\/a>: The Biden Admin just filed an appeal seeking to force religious doctors and hospitals to perform potentially harmful gender-transition procedures against their conscience and professional medical judgment. This is bad for patients, doctors, and religious liberty. 1\/<\/p>&mdash; Luke Goodrich (@LukeWGoodrich) <a href=\"https:\/\/twitter.com\/LukeWGoodrich\/status\/1384596304148398080?ref_src=twsrc%5Etfw\">April 20, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>The appeal challenges a ruling from earlier this year, which had permanently enjoined and restrained the Department of Health and Human Services (HHS) from enforcing the mandate which came into being through the Obama-era &#8220;Affordable Care Act.&#8221; That decision can be read here: (<a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/Sisters-of-Mercy-Opinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">link will open a PDF of the ruling<\/a>).<\/p>\n\n\n\n<p>Leading the charge for the Biden administration will be the head of HHS, Xavier Becerra (though no doubt he&#8217;ll be amply aided by his Assistant Secretary, Dr. Rachel Levine, a man who identifies as a transgender &#8216;woman&#8217;). Becerra, in his previous role as Attorney General of California, was rather infamous in his dogged persecution of the Little Sisters of the Poor in spite of the Supreme Court having ruled in their favor against another &#8220;HHS mandate&#8221; (having to do with the provision of contraceptive and abortifacient coverage in employer health plans, to which the Little Sisters obviously objected). This history was a prominent theme during Becerra&#8217;s confirmation hearing, particularly during question from Senator Ben Sasse (R-NE):<\/p>\n\n\n\n<figure class=\"wp-block-embed aligncenter is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"jeg_video_container jeg_video_content\"><iframe loading=\"lazy\" title=\"Sasse to Becerra: Why Did You Bully Nuns?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/kCCOAwR8d8g?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/div><\/figure>\n\n\n\n<p>On Twitter, Goodrich rightly observed that, quite apart from the questions of religious liberty and conscience, the so-called &#8220;Transgender Mandate&#8221; is simply bad policy:<\/p>\n\n\n\n<figure class=\"wp-block-embed aligncenter is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">The Transgender Mandate not only threatens religious doctors and hospitals. It also threatens patients, as there is ample evidence that certain gender transition procedures can be deeply harmful: <a href=\"https:\/\/t.co\/yKVzmY1uE2\">https:\/\/t.co\/yKVzmY1uE2<\/a><\/p>&mdash; Luke Goodrich (@LukeWGoodrich) <a href=\"https:\/\/twitter.com\/LukeWGoodrich\/status\/1384596308925759493?ref_src=twsrc%5Etfw\">April 20, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>Goodrich went on to point out that not only have federal courts taken this stance in the past, but it was also the finding of the <a href=\"https:\/\/perma.cc\/4LNT-VDYV\" target=\"_blank\" rel=\"noreferrer noopener\">government&#8217;s own doctors<\/a> under the Obama administration!  Asked to opine on a &#8220;National Coverage Determination&#8221; for gender reassignment surgery, the agency experts at the Centers for Medicare &amp; Medicaid Services (CMS) declined, writing in their memo that &#8220;a thorough review of the clinical evidence available&#8221; determined that &#8220;there [was] not enough evidence to determine whether gender reassignment surgery improves health outcomes.&#8221; They also noted that, in some of &#8220;the best designed studies, some reported benefits while <strong><em>others reported harms<\/em><\/strong>&#8221; [emphasis added] .<\/p>\n\n\n\n<p>Goodrich expressed confidence that the Sisters of Mercy and their co-plaintiffs would succeed again in Court, and this confidence does seem well-founded, especially given the current Supreme Court&#8217;s historical record on issues pertaining to religious freedom claims.
