{"id":64616,"date":"2021-04-06T15:01:41","date_gmt":"2021-04-06T19:01:41","guid":{"rendered":"https:\/\/ifamnews.com\/?p=64616"},"modified":"2021-04-08T12:45:46","modified_gmt":"2021-04-08T16:45:46","slug":"iof-joined-by-heritage-and-others-urges-major-course-correction-for-human-rights-council","status":"publish","type":"post","link":"https:\/\/ifamnews.com\/en\/iof-joined-by-heritage-and-others-urges-major-course-correction-for-human-rights-council","title":{"rendered":"IOF,  joined by The Heritage Foundation and others, urges major course-correction for Human Rights Council"},"content":{"rendered":"<p class=\"last-updated\">Last updated on April 8th, 2021 at 12:45 pm<\/p>\n<p><em>IOF has submitted the following statement, cosigned by organizations around the world, in response to the request for input by HRC\u2019s so-called Independent Expert on gender, sexual orientation, and gender identity.<\/em> <em>We have also provided the statement to ambassadors and their missions in Geneva. <\/em> <\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong>\u2018Begin at the Beginning\u2019: A Response to the 2021<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong>\u2018Call for input to a thematic report: Gender, sexual orientation and gender identity\u2019<\/strong><\/p>\n\n\n\n<p>\u201cWhere shall I begin, please your Majesty?\u201d asks the White Rabbit in Lewis Carroll\u2019s <em>Alice in Wonderland<\/em>. The King\u2019s answer offers timeless wisdom: \u201cBegin at the beginning.\u201d In our response to the 2021 \u201c<a href=\"https:\/\/ohchr.org\/EN\/Issues\/SexualOrientationGender\/Pages\/GenderTheory.aspx\">Call for input to a thematic report: Gender, sexual orientation and gender identity<\/a>,\u201d whose stated purpose is \u201cto inform the Independent Expert\u2019s report to be presented to the 47<sup>th<\/sup>&nbsp;session of the Human Rights Council,\u201d we begin at the beginning of the Human Rights Council\u2014then the Human Rights Commission\u2014and its historic issuance in 1948 of the <em>Universal Declaration of Human Rights<\/em>.<\/p>\n\n\n\n<p>As what Ren\u00e9 Cassin, one of the principal drafters, called \u201cthe first document of an ethical sort that organized humanity has ever adopted,\u201d<sup>[1]<\/sup> the UDHR has become, in the words of Professor Hans Ingvar Roth, \u201ca moral guiding star,\u201d<sup>[2]<\/sup> fulfilling the hope of Eleanor Roosevelt that it would serve as \u201cthe international Magna Carta of all men everywhere.\u201d<sup>[3] <\/sup>Its foundational influence on human rights is unprecedented and unparalleled. \u201cThe most impressive advances in human rights,\u201d noted Professor Mary Ann Glendon, \u201cowe more to the moral beacon of the Declaration than to the many covenants and treaties that are now in force.\u201d<sup>[4]<\/sup><\/p>\n\n\n\n<p>But Professor Glendon also sounded a somber warning. \u201cTime and forgetfulness are taking their toll,\u201d she wrote in 2001, as \u201cthe Declaration has come to be treated more like a monument to be venerated from a distance than a living document to be reappropriated by each generation.\u201d For it is being \u201ccompromised by the practice of reading its integrated articles as a string of essentially separate guarantees. Nations and interest groups continue to use selected provisions as weapons or shields, wrenching them out of context and ignoring the rest\u2026 Forgetfulness, neglect, and opportunism have thus obscured the Declaration\u2019s message that rights have conditions\u2014that everyone\u2019s rights are importantly dependent on respect for the rights of others, on the rule of law, and on a healthy civil society.\u201d<sup>[5]<\/sup><\/p>\n\n\n\n<p>And what is the foundation of a healthy civil society? The UDHR leaves no doubt by declaring, in the only provision mentioning a group unit as possessing human rights, that \u201cThe family is the natural and fundamental group unit of society and is entitled to protection by society and the State.\u201d<sup>[6] <\/sup>In other words, the family is not a creation of or subject to the State, but exists prior to the State and possesses inherent dignity and rights which States are morally bound to respect and protect.<sup>[7] &nbsp;<\/sup><\/p>\n\n\n\n<p>Nor is the family a mere social construct to be defined and redefined by ephemeral societal whims, for \u201cin the precise and elegant terms of the Universal Declaration,\u201d explained Professor Richard Wilkins, the family \u201cis the \u2018natural and fundamental group unit of society\u2019 precisely because mounting evidence attests that the survival of society depends on the positive outcomes derived from the natural union of a man and a woman.\u201d<sup>[8]<\/sup><\/p>\n\n\n\n<p>Expressed another way, \u201cthe roles of a father and a mother, and of children with respect to them,\u201d wrote Michael Novak, former ambassador to the Commission on Human Rights, constitute \u201cthe absolutely critical center of social force\u201d<sup>[9]<\/sup>\u2014what Pope Francis has called \u201ca unique, natural, fundamental and beautiful good for people, families, communities and societies\u201d arising from \u201cthe \u201cthe complementarity between man and woman\u2026. Children have a right to grow up in a family with a father and a mother capable of creating a suitable environment for the child\u2019s growth and emotional development.\u201d<sup>[10]<\/sup> It is the same truth expressed in the UDHR\u2019s acknowledgment that \u201cMotherhood and childhood are entitled to special care and assistance,\u201d<sup>[11] <\/sup>and in the statement of the <em>Declaration of the Rights of the Child<\/em> that \u201cmankind owes to the child the best it has to give.\u201d<sup>[12]<\/sup><\/p>\n\n\n\n<p>Building on the UDHR provision that the natural family is \u201centitled to protection by society and the State,\u201d various UN documents have stated that the family is entitled to \u201ccomprehensive protection and support.\u201d<sup>[13]<\/sup> More specifically, Member States are bound by the <em>International Covenant on Economic, Social, and Cultural Rights<\/em> to accord to the family \u201cthe widest possible protection and assistance.\u201d<sup>[14]<\/sup> We affirm in the strongest possible terms that not only is it not discriminatory to fulfill this treaty obligation, but failing to do so constitutes discrimination against society\u2019s natural and fundamental group unit.<\/p>\n\n\n\n<p>To the extent that the Independent Expert implies otherwise (as appears likely, for example, in his mention in paragraph 5 of \u201cprotection of the family\u201d as possibly \u201chinder[ing] the adoption of legislative or policy measures aimed at addressing or eradicating violence and discrimination based on sex, gender, sexual orientation and gender identity\u201d), we object and call for a return to the foundational principles set forth in the UDHR.<\/p>\n\n\n\n<p>We hasten to express our full support of the UDHR\u2019s \u201crecognition of the inherent dignity and of the equal and inalienable rights of all members of the human family\u201d as \u201cthe foundation of freedom, justice and peace in the world,\u201d<sup>[15]<\/sup> and we deplore and denounce all violence against anyone. But ensuring such protection against violence does not negate Member States\u2019 obligation to provide \u201cthe widest possible protection and assistance\u201d to the natural family.<\/p>\n\n\n\n<p>We further express our full support for the UDHR\u2019s recognition that \u201cEveryone has the right to freedom of thought, conscience and religion,\u201d a right that \u201cincludes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.\u201d<sup>[16]<\/sup> This right has been reaffirmed in UN documents such as the <em>Beijing Declaration<\/em>, which states that \u201cfreedom of thought, conscience, religion and belief\u2026 contribut[es] to the moral, ethical, spiritual and intellectual needs of women and men\u201d and \u201cis inalienable and must be universally enjoyed,\u201d<sup>[17]<\/sup> and by treaty protection in the <em>Convention on the Rights of the Child<\/em> declaring that \u201cfreedom of thought, conscience and religion\u201d shall be respected by States Parties and \u201cmay be subject only to such limitations as are prescribed by law <em>and<\/em> are necessary to protect public safety, order, health or morals, or the fundamental rights and freedoms of others\u201d<sup>[18]<\/sup> (emphasis added).<\/p>\n\n\n\n<p>To the extent that the Independent Expert implies otherwise (as appears likely, for example, in his mention in paragraphs 6, 8, and 9 of possible limitation of human rights of LGBT persons by religious narratives or values, or by initiatives in connection with freedom of religion, or by statements of religious leaders), we object and call for a return to the foundational principles set forth in the UDHR. &nbsp;<\/p>\n\n\n\n<p>We also express our full support for the UDHR\u2019s recognition that \u201cEveryone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.\u201d<sup>[19]<\/sup> It takes no imagination to recognize an affront and possible threat to that principle in the Independent Expert\u2019s attempt to collect names of those who disagree with him through his repeated requests (including in paragraphs 4-11) for examples of statements or organizations opposing \u201ccomprehensive sexuality education\u201d or \u201cgender ideology.\u201d No UN agency or appointee should be permitted to engage in action that historically has often been the prelude to encroachment on the freedom of opinion and expression recognized by the UDHR as a fundamental human right.<\/p>\n\n\n\n<p>We urgently call upon the Human Rights Council to return to the foundational principles memorialized by the wise drafters of the UDHR at the beginning of the Human Rights Commission.
