In a welcome piece of good news, a panel of federal judges\nfor the 8th Circuit Court of Appeals last Friday overturned\na previous block<\/a> placed on several pro-life measures in the state of\nArkansas. <\/p>\n\n\n\n

The measures include, among other things, a prohibition of\nthe dilation and curettage method of abortion (wherein a women\u2019s cervix is\ndilated, and the baby dismembered and removed piece by piece), as well as\nprohibitions against sex-selective abortions and a provision that the remains\nbe disposed of in a respectful manner. <\/p>\n\n\n\n

Interestingly, in arguing for their decision, the judges\nused none other than Justice John Roberts\u2019 concurring decision in the\npro-abortion June Medical Services v.\nRusso<\/em>. In the original opinion, Roberts wrote that although he concurred\nwith the decision of Justices Breyer, Ginsburg, Sotomayor, and Kagan, he did\nnot agree with their opinion. In his own opinion, Roberts wrote that he was\njoining in the decision out of respect for what he believed to be the wrongly\ndecided precedent of Whole Woman\u2019s Health\nvs. Hellerstedt<\/em>. In the Arkansas case, the judges emphasized<\/a>\nthat \u201cChief Justice Roberts also addressed the discretion courts must afford to\nlegislatures. He pointed out that \u2018[n]othing about Casey suggested that a\nweighing of costs and benefits of an abortion regulation was a job for the\ncourts.\u2019 . . . Instead, he emphasized that, in the abortion context, \u2018state and\nfederal legislatures [have] wide discretion to pass legislation in areas where\nthere is medical and scientific uncertainty.\u2019\u201d Even though Roberts didn\u2019t agree\nwith the other deciding judges, he nonetheless was one of them, and hence his\nopinion is binding. <\/p>\n\n\n\n

Pro-life advocates have reason to rejoice. Even in rulings like June Medical Services<\/em>, some silver linings may be found\u2014such as the leverage that this particular opinion gave another court to uphold state pro-life laws. And this decision goes hand-in-hand with findings that the abortion rate has continued to drop<\/a>, in spite of everything the Supreme Court can do about it.<\/p>\n","protected":false},"excerpt":{"rendered":"
