{"id":20197,"date":"2020-06-24T09:32:07","date_gmt":"2020-06-24T14:32:07","guid":{"rendered":"https:\/\/ifamnews.com\/?p=20197"},"modified":"2020-11-02T15:28:24","modified_gmt":"2020-11-02T20:28:24","slug":"red-alert-for-human-rights-and-religious-freedom-in-montenegro","status":"publish","type":"post","link":"https:\/\/ifamnews.com\/en\/red-alert-for-human-rights-and-religious-freedom-in-montenegro","title":{"rendered":"Red Alert for Human Rights and Religious Freedom in Montenegro"},"content":{"rendered":"<p class=\"last-updated\">Last updated on November 2nd, 2020 at 03:28 pm<\/p>\n<p>Montenegro still has not\nrevoked the shameful <a href=\"https:\/\/eclj.org\/religious-autonomy\/eu\/overview-on-the-law-against-the-serbian-orthodox-church-in-montenegro\">Law on the Freedom of Religion or\nBelief and the Legal Status of Religious Communities<\/a>, which legitimizes the seizure and\nconfiscation of the property of four dioceses of the Serbian Orthodox Church\n(SOC) in Montenegro. The coronavirus epidemic temporarily disrupted the\nmagnificent processions that were held for almost three months under the slogan\n<a href=\"https:\/\/youtube.com\/watch?time_continue=85&amp;v=34H5SB5aKZM&amp;feature=emb_logo\" target=\"_blank\" rel=\"noreferrer noopener\"><em>We won&#8217;t\ngive up our shrines<\/em><\/a>, until the day when the faithful gathered to commemorate the patron\nsaint of their town and of all the Orthodoxy, Saint Basil of Ostrog.<\/p>\n\n\n\n<p>Although the ties between\nthe <a href=\"https:\/\/en.wikipedia.org\/wiki\/2019%E2%80%932020_Montenegrin_crisis\">Montenegrin regime and international\ncrime<\/a> and\ncorruption are a well-known fact, the authorities do not shy away from inciting\nconflict and provoking the Orthodox people of Montenegro. It is evident that\nthe Montenegrin regime has no intention of accepting the fact that <a href=\"https:\/\/tass.com\/society\/1170217\">its people do not want to give up on their\nfaith, their shrines, their priests, and their Church<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/ifamnews.com\/wp-content\/uploads\/2020\/06\/foto-Savo_Prelevic_Mitropolit-resize-1024x576.jpg\" alt=\"\" class=\"wp-image-20023\" srcset=\"https:\/\/ifamnews.com\/wp-content\/uploads\/2020\/06\/foto-Savo_Prelevic_Mitropolit-resize-1024x576.jpg 1024w, https:\/\/ifamnews.com\/wp-content\/uploads\/2020\/06\/foto-Savo_Prelevic_Mitropolit-resize-768x432.jpg 768w, https:\/\/ifamnews.com\/wp-content\/uploads\/2020\/06\/foto-Savo_Prelevic_Mitropolit-resize-750x422.jpg 750w, https:\/\/ifamnews.com\/wp-content\/uploads\/2020\/06\/foto-Savo_Prelevic_Mitropolit-resize-1140x641.jpg 1140w, https:\/\/ifamnews.com\/wp-content\/uploads\/2020\/06\/foto-Savo_Prelevic_Mitropolit-resize.jpg 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption> Metropolitan Amfilohije enters the hearing at the Montenegrin State Prosecutor\u2019s Office in Pogorica; photo: Savo Prelevi\u0107 <\/figcaption><\/figure>\n\n\n\n<p>The SOC\u2019s most respectable high priest \u2014 83-year-old\nMetropolitan Amfilohije of Montenegro and the Littoral \u2014 was grilled by the\nMontenegrin State Prosecutor\u2019s Office for six whole hours, after which the\nProsecutor filed charges against him, as had been done previously <a href=\"https:\/\/spc.rs\/eng\/bishop_joanikije_budimlyeniksic_arrested\">against\nBishop Joanikije<\/a>. The anticivilization, oppressive authorities in\nPodgorica also served deportation notices to Father Nikolai, Hegumen [Abbot] of\nthe Zlate\u0161 monastery, and to Sa\u0161a Janji\u0107, a priest from Pljevlja. By all\naccounts, ten more priests will be served deportation notices by the\nMontenegrin Border Police in coming days days, regardless of the fact that some\nof them have served as priests in the territory of Montenegro for more than 20\nyears. <\/p>\n\n\n\n<p>The international community must take urgent action\nand endorse the will of the people expressed in the slogan <em>\u201cWe won\u2019t give up\nour shrines.\u201d<\/em> The endorsement should imply exerting pressure on Montenegrin\nauthorities to start implementing their own Constitution and the European\nConvention on Human Rights, specifically the latter\u2019s protection of the freedom of thought, conscience\nand religion (Article 9), implemented by the European Court for Human Rights (Judgment<a href=\"#_ftn1\"><em><strong>[1]<\/strong><\/em><\/a> in <em>Metropolitan Church of Bessarabia and Others, December 2001<\/em>); as well as the UN\u2019s\nUniversal Declaration on Human Rights, which guarantees that everyone has the\nright to the freedom of thought, conscience and religion (Article 18), and the\nfreedom of assembly, opinion and expression (Article 19).<\/p>\n\n\n\n<p><em>iFamNews<\/em>\ngives its full support to the righteous struggle of the clergy and the faithful\npeople of Montenegro for their freedom of religion.<br><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p class=\"has-small-font-size\"><a href=\"#_ftnref1\">[1]<\/a> The Court took the view that the Moldovan Government\u2019s <strong>refusal to recognize the applicant church<\/strong> had constituted an <strong>interference with the right of that church and the other applicants to freedom of religion,<\/strong> as guaranteed by Article 9 \u00a7 1 of the Convention. Finding in particular that in taking the view that the applicant church was not a new denomination, its recognition depending on the will of a recognized ecclesiastical authority, the Metropolitan Church of Moldova, <strong>the Government had failed to discharge their duty of neutrality and impartiality<\/strong>, the Court concluded that the refusal to recognize the applicant church had such consequences for the applicants\u2019 freedom of religion that<strong> it could not be regarded as proportionate to the legitimate aim pursued.
