{"id":19482,"date":"2020-06-18T08:25:24","date_gmt":"2020-06-18T13:25:24","guid":{"rendered":"https:\/\/ifamnews.com\/?p=19482"},"modified":"2020-06-18T15:49:08","modified_gmt":"2020-06-18T20:49:08","slug":"the-supreme-courts-great-betrayal","status":"publish","type":"post","link":"https:\/\/ifamnews.com\/en\/the-supreme-courts-great-betrayal","title":{"rendered":"The Supreme Court\u2019s Great Betrayal"},"content":{"rendered":"\n<p>As acknowledged on its own website, the United States Supreme Court \u201cfunctions as guardian and interpreter of the Constitution,\u201d and its \u201cunique position\u2026 stems, in large part, from the deep commitment of the American people to the Rule of Law and to constitutional government.\u201d But on June 15, 2020, six of the nine Supreme Court justices betrayed the Constitution and the Rule of Law in a <a href=\"https:\/\/supremecourt.gov\/opinions\/19pdf\/17-1618_hfci.pdf\">decision<\/a> which, like Pandora\u2019s Box, will loose upon society a train of troubles. At stake is our freedom of speech, freedom of worship, and protections for family, women, and children. <\/p>\n\n\n\n<p>The <em>Bostock<\/em>\ncase was brought by activists who asked the Court to read \u201csexual orientation\u201d and\n\u201cgender identity\u201d into the word \u201csex\u201d as it appears in Title VII of the Civil\nRights Act of 1964, which prohibits employers from discriminating on the basis\nof \u201crace, color, religion, sex, or national origin.\u201d That the term \u201csex\u201d did\nnot of course include \u201csexual orientation\u201d and \u201cgender identity\u201d has been so\nobvious to everyone that attempts have been made over years by activists to persuade\nCongress to amend the statute by adding those terms. But Congress has never\nbeen willing to do so, and the language remained as it had been originally written.\nNo matter, said the six justices, who suddenly realized that, after all, the word\n\u201csex\u201d in the statute does include \u201csexual orientation\u201d and \u201cgender identity.\u201d &nbsp;<\/p>\n\n\n\n<p>In\nessence, the Court rewrote the statute and thereby exceeded its constitutional\nauthority by usurping the Congressional prerogative to legislate. In one of the\nmost scathing dissents in recent history, Justice Samuel Alito fumed, \u201cThere is\nonly one word for what the Court has done today: legislation. The document that\nthe Court releases is in the form of a judicial opinion interpreting a statute,\nbut that is deceptive\u2026. A more brazen abuse of our authority to interpret\nstatutes is hard to recall. The Court tries to convince readers that it is\nmerely enforcing the terms of the statute, but that is preposterous\u2026. The Court\nattempts to pass off its decision as the inevitable product of the textualist\nschool of statutory interpretation championed by our late colleague Justice\nScalia, but no one should be fooled. The Court\u2019s opinion is like a pirate ship.\nIt sails under a textualist flag, but what it actually represents is a theory\nof statutory interpretation that Justice Scalia excoriated\u2026. Many will applaud\ntoday\u2019s decision because they agree on policy grounds\u2026 But the question\u2026 is not\nwhether discrimination because of sexual orientation or gender identity should\nbe outlawed. The question is whether Congress did that in 1964. It indisputably\ndid not.\u201d Alito\u2019s dissent was joined by Justice Clarence Thomas, while Justice\nBrett Kavanaugh filed a separate dissent. <\/p>\n\n\n\n<p>Actually,\nyou don\u2019t have to be a Supreme Court justice to see the Court\u2019s incoherence in\nits tiring tirade of irrelevance. But Justice Alito left no doubt: \u201cThe Court\ntries to cloud the issue by spending many pages discussing matters that are\nbeside the point\u201d and putting forth arguments that are not only \u201cillogical\u201d but\nalso \u201carrogant\u201d and simply \u201cwrong\u2026. [T]he Court asserts again and again that\ndiscrimination because of sexual orientation or gender identity inherently or\nnecessarily entails discrimination because of sex\u2026. But repetition of an assertion\ndoes not make it so, and the Court\u2019s repeated assertion is demonstrably untrue.\u201d\n<\/p>\n\n\n\n<p>The Court\u2019s\ndecision was all the more shocking for having been joined by Chief Justice John\nRoberts and authored by Justice Neil Gorsuch, whose pretense of honoring the\ntextualist legacy of the late Justice Antonin Scalia comes as a bitter\nsurprise. The case \u201cpoliticizes the judiciary\nand undermines the very thing courts exist to uphold: the Rule of Law,\u201d writes Princeton\nProfessor\nRobert P. George, and \u201cwill destroy what faith\nremains in the moral and intellectual integrity of our courts.\u201d Senator Josh\nHawley calls it a \u201cturning point,\u201d a \u201cseismic decision\u201d that \u201cwill have\neffects that range from employment law to sports to churches.\u201d And according to\nDr. Michelle Cretella, Executive Director of the American College of\nPediatricians, \u201cThe Supreme Court ruled 6-3 against science, common sense and\nthe bedrock of Western Civilization when it redefined \u2018sex\u2019 to include gender\nidentity and thereby erased females from American law.\u201d <\/p>\n\n\n\n<p>If there was ever a time when those who believe in faith, freedom, and family need to speak up and act, it is now. As with Sir Winston Churchill, we cannot afford to give up. IOF President Brian Brown has urged, \u201cIf we are going to protect ourselves from cultural elites imposing their values on us and the country, we&#8217;re going to have to fight back stronger and harder than we ever have before\u2026 We\u2019ve got to hammer the politicians to act, or throw them out of office if they refuse. We can\u2019t go silently into the night and let our nation be turned into an unrecognizable country ruled by cultural incoherence, with no commitment to universal truths, no respect for the Constitution or the rule of law, and no understanding of the importance of timeless values.
