A federal appeals court has handed down what observers are calling the most significant pro-life legal ruling since the Supreme Court’s 2022 Dobbs decision — blocking the mail-order distribution of mifepristone in states where abortion is prohibited.
The Fifth Circuit Court of Appeals ruled in favor of Louisiana, which had challenged the FDA’s policy allowing mifepristone to be prescribed and dispensed without an in-person consultation. The three-judge panel — two appointed by President Trump, one by President Bush — found that the policy enabling abortion pills to be sent by mail was facilitating nearly 1,000 illegal abortions per month in Louisiana alone.
Approximately two-thirds of all abortions in the United States are now carried out using pills rather than surgical procedures — making the distribution channel a central battleground in the post-Dobbs era.
The decision is expected to be appealed to the Supreme Court, but legal analysts note the court’s current composition makes confirmation of the ruling likely.
